“KWIK KOPY WIN A PICANTO 2023” PROMOTION

TERMS AND CONDITIONS

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoters are Kwik Kopy Central City Group (ABN 54 146 247 565) of 70 Pitt Street Sydney NSW 2000, telephone (02) 8226 9200 and Kwik Kopy Wynyard Group (ABN 60 606 071 924) of B1/70 Pitt Street Sydney NSW 2000, telephone (02) 9262 4040.
3. Entry is only open to registered businesses operating in New South Wales (each an “Eligible Business”).
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The Eligible Business must be within the Promoters’ trading terms throughout the Promotional Period and must not have overdue monies owing as at the draw date in order to be eligible to claim any prize.
6. Promotion starts on 01/06/23 and ends at close of business on 30/11/23 for purchases, with final entries closing at 11:59pm AEDST on 07/12/23 (“Promotion Period”).
7. The Promotional Period will be comprised of six (6) monthly draws (each a “Monthly Draw”).  
8. To be eligible to enter a Monthly Draw, an Eligible Business must spend a minimum of $250.00 (ex. GST) in a single transaction at a participating Kwik Kopy Centre during the Purchase Period for the relevant Monthly Draw, as outlined in the table in clause 9, (each a “Qualifying Transaction”). One (1) automatic entry will be awarded for each $250 (ex. GST) spent in a single transaction. To clarify, if an Eligible Business spends between $250 and $499 in a single transaction, they will be eligible to receive one automatic (1) entry for that transaction, and if an Eligible Business spends between $500 and $749 in a single transaction they will be eligible to receive two (2) automatic entries in respect of that transaction. A full list of participating Kwik Kopy Centres can be found at the end of these Terms and Conditions.
9. The draw conducted for the month of June will take place at Anisimoff Legal,5/210 Central Coast Highway, Erina NSW 2250 and each Monthly Draw from July onwards will take place at G13, Amy Close, North Wyong NSW 2259, at 12:00pm AEST/AEDST as the case requires, on the dates outlined in the table below. The Promoters may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.  The authorised representative of each winning Eligible Business will be notified by email and the names of each winning Eligible Business will be published online at www.kwikkopy.com.au/kia on the dates indicated in the table below:
   
   
10. The first two (2) valid entries drawn in each Monthly Draw will each win one (1) $200 Merivale Gift Card to use at any Merivale Group restaurant(each a “Monthly Draw Winner”).
11. At the end of the promotion, all Monthly Draw Winners will be placed into a major draw (“Major Draw”). The Major Draw will take place at Anisimoff Legal, G13, Amy Close, North Wyong NSW 2259 at 1.30pm AEDST on 20/12/23. The authorised representative of each winning Eligible Business will be notified by email and the names of each winning Eligible Business, from the Major Draw, will be published online at www.kwikkopy.com.au/kia  from 20/12/23.
12. The first valid entry drawn in the Major Draw will win a 2023 Kia Picanto S manual car. Total prize value is up to $18,890 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State).  Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner’s colour preference (excluding metallic options), subject to availability. The winner must collect the prize from their nearest authorised Kia dealership.
13. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
14. The second valid entry drawn in the Major Draw will win a $4,000 Royal Caribbean cruise voucher.
15. Any ancillary costs associated with redeeming the Merivale Gift Card and Royal Caribbean vouchers are not included. Any unused balance of a Merivale Gift Card and Royal Caribbean cruise vouchers will not be awarded as cash. Redemption of a Merivale Gift Card and Royal Caribbean cruise voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
16. The next three (3) valid entries drawn in the Major Draw will each win one (1) RealRyder ABF8 Indoor Cycling Bike valued at $3,200.
17. Eligible Businesses must retain their original purchase receipt/invoice for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoters, result in invalidation of ALL of an Eligible Business’s entries and forfeiture of any right to a prize. Purchase receipt/invoice must clearly specify the Kwik Kopy store of purchase, the amount spent and that the purchase was made during the relevant Purchase Period and prior to entry.
18. The Promoters reserve the right, at any time, to verify the validity of entries and Eligible Businesses and reserve the right, in their sole discretion, to disqualify any Eligible Business who the Promoters have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.
19. Incomplete transactions will be deemed ineligible.  Entry submissions connected with a Qualifying Transaction that is refunded in full or in part may either be deemed ineligible or have entries subtracted, as relevant to the net balance of transaction after the refund.
20. If there is a dispute as to the identity of an Eligible Business, the Promoters reserve the right, in their sole discretion, to determine the identity of the Eligible Business.
21. The Promoters’ decisions are final and no correspondence will be entered into.
22. Prizes will be awarded to the owners of the winning Eligible Businesses.
23. Subject to the unclaimed prize draw clause, if for any reason a winning Eligible Business does not redeem a prize by the time stipulated by the Promoters, then the prize will be forfeited.
24. If any prize is unavailable, the Promoters, at their discretion, reserve the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
25. The total prize pool value is $34,890.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
27. A draw for any unclaimed prizes may take place on 22/01/24 at the same time and place as the Major Draw, subject to any directions from a regulatory authority. Winning Eligible Businesses, if any, will be notified in writing and by telephone within two (2) business days of the draw and their names will be published at www.kwikkopy.com.au/kia  from 24/01/24.
28. Eligible Businesses consent to the Promoters using their details in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.As a condition of accepting the prize, the authorised representative on behalf
30. of the Eligible Business must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  
31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Business; (f) use of the prize.
33. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.kwikkopy.com.au/privacy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
